Dialed and Driven Mentality

Terms of Service

Effective August 11, 2026

These terms govern access to Dialed and Driven Mentality by Shopify merchants, their authorized coaches, and eligible athletes. By installing, purchasing, accessing, or using the service, you agree to these terms.

Eligibility and athlete accounts

Athlete users must be at least 13 years old. An athlete may not use the portal or submit information if under 13. Merchants are responsible for inviting only eligible users and for managing their Shopify customer accounts and program access. You must provide accurate account information, protect access credentials, and notify us of suspected unauthorized access.

The service

The service provides athlete profiles, goal planning, daily and evening reflections, progress summaries, lessons, quizzes, and coach administration. Features and curriculum availability may depend on the merchant's configuration, content rights, Shopify services, and third-party integrations.

Subscription and cancellation

The merchant subscription is $8.53 USD every 30 days, billed by Shopify. This is the rounded 30-day billing equivalent of $1.99 per week. The current plan has no free trial. A merchant may cancel from the app's Plan and billing screen or through Shopify. Cancellation stops future renewals and is not prorated, except where applicable law requires otherwise. Shopify's billing terms also apply.

Acceptable use

You may not:

• Use the service for an unlawful, fraudulent, or abusive purpose.
• Attempt to bypass access controls, probe security, disrupt service, scrape private content, or access another person's account.
• Upload content you do not have the right to use or that violates another person's privacy or intellectual-property rights.
• Use the service to collect information from children under 13.

Dialed and Driven Mentality is an education, habit-training, and accountability tool. It is not medical, mental-health, emergency, legal, or other professional advice. It does not diagnose or treat a condition, and it does not guarantee an athletic, academic, health, or financial result. Contact an appropriate qualified professional or emergency service when needed.

Content and intellectual property

The service, branding, software, and provided program materials are protected by applicable intellectual-property laws. Subject to these terms and an active subscription, merchants and authorized athletes receive a limited, non-exclusive, non-transferable right to use the service for its intended purpose. Users retain rights in content they submit and grant the permissions reasonably necessary to store, process, display, and transmit it to operate the service.

Third-party services

Shopify, GoHighLevel, linked media hosts, and other third-party services have their own terms and privacy practices. We are not responsible for third-party services outside our control. Changes or outages in those services may affect app availability.

Suspension and termination

We may suspend or terminate access when reasonably necessary to address nonpayment, a security risk, unlawful conduct, material breach of these terms, or service discontinuation. Obligations that by their nature should survive termination remain in effect.

Service availability and liability

The service is provided on an "as available" basis. To the extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses caused by third-party services. Nothing in these terms excludes liability that cannot legally be excluded or limits rights that cannot legally be waived.

Changes

We may update the service or these terms. The effective date above identifies the current version. Material changes will be communicated through a reasonable channel. Continued use after updated terms take effect constitutes acceptance where permitted by law.
